Terms & Conditions
ARTICLE 1 – DEFINITIONS
In these Conditions/Terms the following definitions are applicable:
- Consideration time: the term during which the consumer can execute the right of withdrawal.
- Consumer: the natural person not dealing on behalf of a company or profession and who comes to a distance agreement with Amsterdam Vintage Wine.
- Day: calendar day.
- Durable Medium: any instrument which enables the recipient or Amsterdam Vintage Wine to store information addressed personally to them in a way accessible to future reference for a period of time adequate to the purpose of the information and which allows the unchanged reproduction of the information stored.
- Right of Withdrawal: the possibility for the consumer to terminate the distance agreement within the consideration term.
- Entrepreneur: the natural person or corporation who offers distance products to consumers.
- Distance Agreement: an agreement based on a corporate organized system of distance sales of products and services including the closing of an agreement using one or more techniques of distant communication.
- Technique of distant Communication: a means that can be used to close an agreement without the consumer and Amsterdam Vintage Wine have gathered together in the same place and at the same time.

ARTICLE 3 – RELEVANCE
These general conditions/terms apply to any offer of Amsterdam Vintage Wine and to every finalized distance agreement between entrepreneur and consumer.
Before the distance agreement is concluded, the text of the general conditions/terms is being made available to the consumer. At any time the general conditions of Amsterdam Vintage Wine can be found on the website. If this is reasonably not possible before the distance agreement is concluded, it will be indicated that the general conditions/terms can be seen at Amsterdam Vintage Wine and on request of the consumer these general conditions/terms shall be sent to the consumer as soon as possible.
If the distance agreement is concluded electronically, notwithstanding the previous article and before the distance agreement is concluded, the text of the general conditions/terms can be made available electronically to the consumer in such a way that the text can be saved in a simple way on a durable medium.
ARTICLE 4 – OFFER
If an offer has a limited validity or has other specifications, this will be emphatically mentioned.
The offer contains a complete and accurate description of the offered products and services. The description is sufficiently detailed to enable a proper consumer's assessment of the products/services. The images used by Amsterdam Vintage Wine are true representations of the products and services. Obvious mistakes and errors do not bind Amsterdam Vintage Wine.
Each offer contains such information that it is clear for the consumer which rights and obligations are related to the offer when it is accepted by the consumer. This concerns in particular:
- Price exclusive taxes
- Possible costs of delivery
- The manner in which the agreement has been concluded and the necessary signatures
- Whether to apply the right of withdrawal
- The method of payment, delivery and performance of the contract
- The deadline for accepting the offer or the period within which Amsterdam Vintage Wine guarantees the price
- The level of the rate for distance communication if the costs for the usage of the technology for distance communication are calculated on another ground than the regular fare for communication
- If the agreement after the conclusion is archived and if so how to consult it for the consumer
- The manner in which the consumer, before concluding the agreement, can check and if necessary also restore the information provided by them under the agreement
- Any other languages, including Dutch, for the agreement
- The codes of conduct to which Amsterdam Vintage Wine is subject and the manner in which the consumer can consult electronically the codes of conduct
ARTICLE 5 – THE AGREEMENT
The agreement is finalized, subject to the provisions in paragraph 4, at the moment the consumer accepts the offer and meets the conditions.
If the consumer has accepted electronically the offer, Amsterdam Vintage Wine immediately confirms electronically that he has received the acceptance of the offer. As long as Amsterdam Vintage Wine has not confirmed the acceptance, the consumer can terminate the agreement.
If the agreement is concluded electronically, Amsterdam Vintage Wine will take appropriate technical and organizational measures to protect the electronic data transfer and ensure a safe web environment. If the consumer can pay electronically, Amsterdam Vintage Wine will observe the necessary security measures.
Amsterdam Vintage Wine can notify or check, within the legal framework, if the consumer can meet the payment obligations, and also check all important facts and factors which are needed to finalize a sound distance agreement. If Amsterdam Vintage Wine based on research, has good reasons not to conclude the agreement then they are entitled to motivate and to refuse an order/request or connect special conditions to the execution of the offer.
Amsterdam Vintage Wine shall send the following information with the products or services, written or in such a manner that the consumer can store in an accessible way the data on a durable medium:
- The address of the company for the consumer to file complaints
- The conditions and the way how the consumer can execute the right of withdrawal and a clear indication related to the exclusion of the right of withdrawal
- Information about after sales guarantees and services
- Article 4 paragraph 3 unless Amsterdam Vintage Wine has already sent this information before the execution of the agreement
ARTICLE 6 – RIGHT OF WITHDRAWAL
Cooling off period:
After purchasing products the consumer has the possibility to disband the agreement without giving reasons during 1 day. The cooling off period starts on the day after the consumer receives the product or a pre-designated representative by the consumer made known to Amsterdam Vintage Wine.
Why 1 day instead of 14 days:
Under EU consumer law, the standard cooling off period for online purchases is 14 days. However, wine is a fragile and perishable product that requires careful handling and proper storage conditions to maintain its quality and value. Once a bottle leaves our climate-controlled facilities, we cannot guarantee that it has been stored correctly. For this reason, we are unable to resell returned bottles without absolute certainty that they have been handled with the utmost care. This constitutes a legitimate exception under Article 16(d) of the EU Consumer Rights Directive, which permits a reduced cooling off period for goods that can deteriorate or expire rapidly and goods that are not suitable for return due to their nature.
Conditions during cooling off period:
During the cooling off period the consumer shall treat the product and the package carefully. They shall unpack the product, but not open the bottle. The product should be used only to that extent as far as it is necessary to judge if they wish to keep the product. If they do want to execute the right of withdrawal, they shall return the product with all accessories in the original conditioning and packaging to Amsterdam Vintage Wine, in accordance with the provided reasonable and clear instructions.
Deliverance of Services:
In order to execute the right of withdrawal, the consumer must abide by the reasonable and clear instructions provided by Amsterdam Vintage Wine at the offer or finally at the deliverance of the service.
ARTICLE 7 – WITHDRAWAL COSTS
If the consumer executes the right of withdrawal, they will have to pay no more than the costs of returning the product.
If the consumer has made a payment, Amsterdam Vintage Wine shall pay back this amount as soon as possible but no later than within 14 days after the repeal or after the return shipment.
ARTICLE 8 – EXCLUSION RIGHT OF WITHDRAWAL
Amsterdam Vintage Wine can exclude the right of withdrawal of the consumer for as far as foreseen in paragraph 2 and 3. The exclusion of the right of withdrawal applies only if Amsterdam Vintage Wine has clearly mentioned this at least in time before the conclusion of the agreement.
Exclusion of the right of withdrawal is only possible for the following products:
- Which are established by Amsterdam Vintage Wine according to specifications of the consumer
- That they are clearly personal in nature
- Which cannot be returned because of their nature
- That can spoil or age quickly
- Whose price is bound to fluctuation on the financial market which Amsterdam Vintage Wine has no influence
ARTICLE 9 – PRICING
During the validity period mentioned in the offer, the prices of the offered products and services shall not be raised save for price changes due to changing VAT rates.
Notwithstanding the previous paragraph Amsterdam Vintage Wine can offer products and services with variable prices when these prices are subject to fluctuations on the financial market and where Amsterdam Vintage Wine has no influence. This bondage to fluctuations and the fact that the mentioned prices are target prices will be mentioned with the offer.
The in the offer mentioned prices exclude VAT, unless otherwise stated.
ARTICLE 10 – CONFORMITY AND GUARANTEES
Amsterdam Vintage Wine ensures that the products and services measure up to the agreement, ensures the in the offer mentioned specifications, ensures reasonable requirements, soundness and/or usefulness and ensures on the date of the establishment the existing legal provisions and/or government regulations.
A guarantee provided by Amsterdam Vintage Wine, manufacturer or importer does nothing to alter the rights and claims which the consumer under the agreement can put forward against Amsterdam Vintage Wine.
ARTICLE 11 – DELIVERY AND EXECUTION
Amsterdam Vintage Wine shall observe in utmost care the reception and execution of orders of products and when assessing applications for services.
Shipping costs €15 per order. Free shipping applies to orders over €300 or for deliveries within Amsterdam. All packages are fully insured until they reach the consumer.
The address that has been made known by the consumer to Amsterdam Vintage Wine is considered to be the delivery place.
Taking into account what is stated in article 4 of the general conditions/terms, Amsterdam Vintage Wine shall execute the accepted orders expeditiously but not later than within 30 days unless a longer period has been agreed. If the delivery is delayed or if a delivery cannot or partially be executed, the consumer is notified about this no later than 30 days after they placed the order. In that case the consumer has the right to terminate the agreement without any further cost and they are entitled to any compensation.
In the event of termination in accordance with the previous paragraph Amsterdam Vintage Wine shall pay back the amount that the consumer has paid as soon as possible but no later than 30 days after the termination.
If the delivery of an ordered product appears to be impossible, Amsterdam Vintage Wine shall strive to make available a replacement product. At least before the delivery it will be mentioned in a clear and understandable manner that a replacement product will be delivered. The right of withdrawal cannot be ruled out with regard to replacement products. The costs of a possible return shipment come at the expense of Amsterdam Vintage Wine.
The risk of damage and/or loss of products rests with Amsterdam Vintage Wine until the moment of delivery at the consumer or a pre-designated and announced representative to Amsterdam Vintage Wine, unless otherwise expressly agreed. If you receive a damaged product, you should report this by email within three days. You can send this email to: info@amsterdamvintagewine.com
ARTICLE 12 – PAYMENTS
Unless otherwise agreed, the amounts due have to be met by the consumer, before Amsterdam Vintage Wine will ship the product to the consumer. In case of an agreement to provide a service the cooling off period starts after the consumer has received the confirmation of the agreement.
The consumer has the duty to notify Amsterdam Vintage Wine about inaccuracies in the payment details.
In case of default by the consumer Amsterdam Vintage Wine has, subject to legal restrictions, the right to charge the reasonable costs which are made known to the consumer in advance.
ARTICLE 13 – COMPLAINTS
Amsterdam Vintage Wine features a sufficiently publicized complaints procedure and handles the complaint according to this complaints procedure.
Complaints about the execution of the agreement must be described fully and clearly within reasonable time submitted to Amsterdam Vintage Wine after the consumer has observed the defects.
ARTICLE 14 – AGE VERIFICATION
You must be at least 18 years old to purchase alcoholic beverages from Amsterdam Vintage Wine. By placing an order, you confirm that you are of legal drinking age in accordance with Dutch law.
We reserve the right to request proof of age and to refuse delivery if we are not certain that the recipient is 18 years or older. All deliveries require an adult signature (18+).
ARTICLE 15 – "AS IS" CONDITION
All wines sold "as is":
All wines sold by Amsterdam Vintage Wine are sold in "as is" condition. Vintage wines are unique products with their own history and characteristics. We describe our wines with the utmost care and provide photographs, but it remains your responsibility to perform your own research prior to purchasing.
Available information:
The following information is standardly available for each wine: photographs on the website depicting the front of the bottle, detailed product descriptions including vintage, producer, region, and tasting notes where available. You may request additional photographs or information by contacting us.
Limitation of liability:
Amsterdam Vintage Wine shall not be liable for defects that could not have been observed. This applies even if a latent defect renders the wines unfit for the purpose for which you intended them. It applies furthermore in circumstances where such defect impairs the utility of your purchase to such an extent that you would not have purchased the wines at all, or would have purchased the wines only at a lower price, had you been aware of such defects.
This exclusion of liability for claims shall not apply in cases involving factually substantiated doubts as to the authenticity of a bottle.
Your right of withdrawal:
Notwithstanding the "as is" condition, you are still covered by your 1-day right of withdrawal as described in Article 6. You may return any purchase within 1 day of delivery, no questions asked. Should you discover after the 1-day cooling off period that your decision was based on only a portion of the available information, this shall not constitute grounds for rescission of the purchase or for any claim for damages.
ARTICLE 16 – AUTHENTICITY CLAIMS
Separate from standard returns:
Authenticity claims are a separate process from your standard 1-day right of withdrawal. While you may return any purchase within 1 day for any reason, authenticity concerns can be raised for a longer period as described below.
Verification:
Prior to offering any wine for sale, Amsterdam Vintage Wine subjects it to verification against certain criteria, utilising its accumulated expertise regarding wines and the provenance of the bottles. Notwithstanding all such efforts, the authenticity of a bottle may nonetheless be called into question by you or by third parties.
Timeframe for authenticity claims:
If you have factually substantiated doubts about the authenticity of a bottle, you may raise a claim within four (4) weeks following receipt of the purchase. An exception shall apply to buyers located outside the European Union: for such buyers, the applicable period shall be three (3) months commencing from the date of export from the European Union.
Requirements for claims:
As prerequisites for any such restitution, Amsterdam Vintage Wine shall require:
- That you specify the factual and legal basis for your claim
- That you furnish proof that the bottle was purchased directly from Amsterdam Vintage Wine
- That you return the wine to Amsterdam Vintage Wine – if so requested – free and clear of any third-party claims or encumbrances
Exclusions:
Expressly excluded from any successful claim premised on doubts as to the authenticity of a bottle shall be any variance in taste from that which you anticipated. Amsterdam Vintage Wine maintains an extensive wine database and possesses substantial professional experience in the field.
ARTICLE 17 – GOVERNING LAW
These terms and conditions are governed by Dutch law. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

Shipping costs
Shipping costs €15 per order. Free shipping applies to orders over €300 or for deliveries within Amsterdam.
Delivery options
We ship all orders via UPS, PostNL, or our own courier service. For deliveries within Amsterdam, we use our own courier.
Delivery times
Standard delivery takes 2-3 business days. We process and ship orders as quickly as possible, and you'll receive a confirmation email with tracking information once your order is on its way.
Insurance
All packages are fully insured until they reach you. Your wine is protected throughout the entire delivery process.
Signature required
All deliveries require an adult signature (18+). Someone of legal drinking age must be present to receive the package. We may request proof of age upon delivery.
Damaged deliveries
If you receive a damaged package, please contact us within 3 days at info@amsterdamvintagewine.com with photos of the damage. We'll arrange a replacement or full refund at no extra cost to you.
RETURNS
Return policy
Changed your mind? You can return your order within 1 day of delivery, no questions asked. All our wines are sold in "as is" condition, but you still have a full right of withdrawal. Simply contact us and we'll guide you through the process.
Why 1 day instead of 14 days?
Wine is a fragile and perishable product that requires careful handling and proper storage. Once a bottle leaves our climate-controlled facilities, we can't guarantee how it's been stored. This is why we offer a 1-day return window instead of the standard 14 days – we simply can't resell returned bottles without being certain they've been handled with care.

Return costs
You're responsible for the shipping costs when returning items. However, if we made an error or sent a damaged product, we'll cover all return costs.
REFUNDS
Processing time
Once we receive your return, we'll inspect it and notify you by email. Approved refunds are processed within 14 days and credited to your original payment method.
Non-returnable items
Opened bottles cannot be returned due to health and safety regulations. If you believe a bottle is faulty or corked, please contact us with details and we'll find a solution.

How do I place an order?
Browse our collection, add items to your cart, and proceed to checkout. You'll need to provide delivery information and payment details. After completing your order, you'll receive a confirmation email. If the consumer has accepted electronically the offer, Amsterdam Vintage Wine immediately confirms electronically that we have received the acceptance.
What payment methods do you accept?
We accept all major credit and debit cards, as well as iDEAL and other Dutch payment methods through our secure payment provider Mollie. Unless otherwise agreed, the amounts due have to be met by the consumer before Amsterdam Vintage Wine will ship the product.
Can I cancel or modify my order?
Please contact us immediately at info@amsterdamvintagewine.com or call +31 6 48629525 if you need to cancel or modify your order. As long as Amsterdam Vintage Wine has not confirmed the acceptance, the consumer can terminate the agreement. We'll do our best to accommodate your request if the order hasn't been shipped yet.

What if my order arrives damaged?
The risk of damage and/or loss of products rests with Amsterdam Vintage Wine until the moment of delivery. If you receive a damaged product, you should report this by email within three days to info@amsterdamvintagewine.com. We will arrange for a replacement or full refund, including any delivery charges.
RETURNS & REFUNDS
What is your return policy?
You can return your order within 1 day of delivery, no questions asked. All our wines are sold in "as is" condition, but you still have a full right of withdrawal. Bottles must be unopened and in their original packaging. We offer a 1-day window (instead of the standard 14 days) because wine is fragile and perishable – once it leaves our climate-controlled storage, we can't guarantee how it's been handled.
Can I return opened bottles?
No, opened bottles cannot be returned due to health and safety regulations. The exclusion of the right of withdrawal applies to products which cannot be returned because of their nature. However, if you receive a damaged or defective product, please contact us immediately for a replacement or refund.
How long does a refund take?
If the consumer has made a payment, Amsterdam Vintage Wine shall pay back this amount as soon as possible but no later than within 14 days after the repeal or after the return shipment. The refund will be processed and automatically applied to your original method of payment.
WINE CARE
How should I store my wine?
Store wine bottles horizontally in a cool, dark place with consistent temperature (ideally 12-15°C). Avoid direct sunlight and temperature fluctuations. For vintage wines, proper storage is essential to maintain quality.
Are your wines authentic?
Yes, all our wines are verified using our accumulated expertise and provenance documentation. If you have authenticity concerns after receiving your order, you have 4 weeks to raise a claim (3 months if you're outside the EU). We take authenticity very seriously and will work with you to resolve any legitimate concerns.
What does "as-is" condition mean?
All our wines are sold in "as is" condition. We describe our wines with utmost care and provide photographs, but vintage wines are unique products with their own history. We're not liable for defects that couldn't have been observed before sale. Important: you can still return any purchase within 1 day, no questions asked. Additionally, authenticity concerns can be raised within 4 weeks of receipt (a separate process from standard returns).
